BRAINEYE SOCIAL MEDIA COMPETITION TERMS

“Promoter”: Neuro Optica Operations Pty Ltd t/as BrainEye (“BrainEye”).
The Competition Terms below describe the “Play Safe” competition conducted by BrainEye, for a marketing purpose (“Competition”).
- These Competition Terms are between each person entering in accordance with the details on the relevant social media post, and these Competition Terms, and BrainEye (“Competition Terms”).
- Information on how to enter form part of these Competition Terms. Entry into this Competition is deemed to be an acceptance of these Competition Terms, and the policies unilaterally managed by BrainEye, including but not limited to the BrainEye Privacy Policy.
- The Competition commences on 23 January at 1pm AEST and concludes 6 February at 1pm AEST (‘Competition Period’).
- Entry is open to Australian residents. Entry is open to people 18 years of age or older as of the beginning of the Competition Period, who are not an employee of the Promoter or any of its affiliated companies or domiciled with an employee of the Promoter or any of its advertising or promotional agencies.
- To enter this Competition on Instagram and become an “Entrant”: Entrants must follow @braineyeapp on Instagram, “like” the relevant post, tag another user of Instagram, describe “What’s your go-to piece of gear for staying safe in sport?” during the Competition Period. Only one entry is permitted per legitimate Instagram account.
- Entrants who do not fulfill the requirements of the entry process will not be eligible to participate in the Competition.
- The draw will take place on 13 February at 12pm AEDT at 20-40 Meagher St, Chippendale, NSW (“Draw”). The prize will be drawn in accordance with these Competition Terms, and is the “Winner”.
- There will be a total of 1 winner of this Competition. The Winner will be drawn at random at the Draw and will receive a $500 AUD Rebel Sport Voucher (“Prize”). The Prize is not transferable, redeemable or refundable for cash, and be used in accordance with the relevant terms and conditions, as accepted by the Winner at the time. Any unused portions or elements of the Prize are forfeited. Lost, stolen or damaged gift cards will not be replaced or refunded.
- It is acknowledged by all those entering the Competition that there is no official or authorized brand association with the “Rebel Sport” brand or business.
- The Winner will be notified in writing within 2 business days of the Draw using contact details provided to the Promoter, or publicly available social media account messaging services, and their name will be published on BrainEye social media accounts.
- The Promoter’s decision regarding any aspect of this Competition is final and no correspondence will be entered into.
- Any ancillary costs associated with redeeming the Prize is the sole responsibility of the Winner. The Promoter accepts no responsibility for any variation in the Prize value. If any element of the Prize is not available due to unforeseen circumstances, the Promoter may provide a substitute prize of equal or greater value.
- If a Prize remains unclaimed after 3 months of the Draw date, the right of the Winner to receive the Prize is forfeited and extinguished, and Promoter may provide the Prize to another individual at their absolute discretion.
- The Promoter will take all reasonable steps to deliver the Prize to the Winner within 28 days of the Draw.
- Entrants who provide incorrect or fraudulent information are ineligible to participate in the Competition. Any attempt to enter multiple email addresses or pen names, copy another person’s work, or any use of robotic, automatic, programmed or any other entry method not authorized by these Competition Terms may result in their entry being cancelled by the Promoter, in their absolute discretion. No responsibility is accepted for any entries that are incomplete, incomprehensible, late, lost, misdirected or not received by the Promoter within the Competition Period.
- This Promotion may be promoted through third party websites such as Facebook or Instagram (“Social Platforms”). Entrants must at all times comply with the terms of service for those Social Platforms when using them to participate in this Competition. This Competition is in no way sponsored, endorsed or administered by, or associated with, those third-party websites.
- The Promoter and its associated agencies and companies, Social Platforms, and third party websites (“Authorised Third Parties”) will not be liable for any damage or loss whatsoever suffered or sustained regarding this Competition or prizes awarded in the course of this Competition, except for liability which cannot be excluded by law (in which case that liability is limited to the minimum permitted by law).
- The Promoter and Authorised Third Parties are not liable for any incorrect, incomplete, or inaccurate information received or not received or any problems or technical failures (including any internet, telecommunications or website technical problems or any damage to computers) in the course of or in connection with this Competition if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures.
- The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Competition Terms or engaged in any unlawful or improper conduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoter also reserves the right to request appropriate identification or other documentation to confirm an entrant’s eligibility to enter and claim the Prize. If the identity of an entrant has not been verified or validated to the Promoter’s satisfaction, that entry may be deemed invalid by the Promoter, in their absolute discretion.
- If for any reason this Competition is incapable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Competition, subject to the approval or directions of a relevant regulatory authority, if applicable.
- At the request of the Promoter, the Winner agrees to participate in any promotional activities planned by the Promoter and consents to their name and image, and the content on their social media accounts being used in the Promoter’s marketing materials related to the Competition.
- All entries become the property of the Promoter. The Promoter collects entrants’ personal information to conduct the Competition. By entering this Competition entrants agree that: (1) the Promoter may disclose personal information to its contractors and agents for the purpose of assisting in the conduct of this Competition; and (2) the Promoter may retain and use personal information for future marketing purposes in relation to its products, services, and offers without compensation to the entrant. By subscribing to receive the Promoter’s marketing communications and entering this Competition, entrants’ consent to the Promoter collecting their personal information in accordance with the Promoter’s privacy policy, with the latest policy always available at the BrainEye website.
- The Competition Terms are governed by the laws of Australia and any dispute shall be subject to the exclusive jurisdiction of the Australian Courts.
